Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kenstone Care platform provided by Kenstone Care, Inc. By using the service, you agree to these Terms.
1. The service
Kenstone Care is an operations platform that helps employers offer childcare benefits, processes payments to childcare providers, and prepares documentation to support IRC §45F tax credit claims.
2. Not tax or legal advice
Kenstone Care does not provide tax, legal, or accounting advice and does not file IRS Form 8882 or any tax return on your behalf. We prepare documentation; your CPA or tax advisor is responsible for determining eligibility and filing. You should consult your own advisors.
3. Accounts and eligibility
You must provide accurate information and are responsible for activity under your account. You must have authority to bind your organization when you accept these Terms on its behalf.
4. Acceptable use
You agree not to misuse the service, interfere with its operation, attempt to access it without authorization, or use it in violation of applicable law.
5. Payments and billing
Where we process payments to providers on your behalf, you authorize the associated charges and agree that payouts are contingent on collected employer funds. Fees and billing terms are set out in your separate agreement with us.
6. Intellectual property
The service, including its software, content, and trademarks, is owned by Kenstone Care or its licensors. These Terms do not grant you any ownership rights in the service.
7. Disclaimers
The service is provided "as is" without warranties of any kind, to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, Kenstone Care will not be liable for indirect, incidental, or consequential damages arising from your use of the service.
9. Termination
We may suspend or terminate access if you violate these Terms or to protect the service. You may stop using the service at any time, subject to your separate agreement with us.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
